Hospital found liable for $4.25 million in lawsuit

Friday, October 10 | 2:30 p.m.

Evergreen Hospital in Kirkland has been ordered to pay $4.25 million for a troubled birth that left a girl with severe brain damage.

Hospital officials say'll appeal the King County Superior Court jury award to Erik and Sharla Tavares and their 5-year-old daughter, Miriam Tavares. She has cerebral palsy and severe brain damage.

According to the Tavarases, the mother arrived at the hospital with contractions a day before she was scheduled for a Caesarian section. They say nurses failed to notify an obstetrician that a high-risk patient had arrived, so the doctor went home for dinner, and they blame the delay in his return for their daughter's severe problems.

Hospital officials say the baby's injuries occurred before the mother arrived at the hospital.
