The Lewis County prosecutor is preparing for the third trial of a man who had two earlier murder convictions thrown out.
Prosecutor Michael Golden told KITI there will be no plea bargain. He's seeking a second-degree murder conviction of Kenneth Slert.
Slert is accused of shooting John Benson after they met while hunting near Packwood and began drinking together at Slert's camp.
Slert's first conviction was thrown out because he should have been allowed to argue self-defense. The second conviction was thrown out because the judge should have withdrawn because of prior relationships with several witnesses.
Slert made an initial appearance Monday and is being held on $1 million bail.
