PORTLAND, Ore. (AP) — Portland police Commissioner Dan Saltzman says a Portland police sergeant who unholstered his gun during an off-duty road dispute with another motorist will be assigned to a desk job.

Saltzman said Monday he made the decision about Sgt. Kyle Nice in consultation with Police Chief Rosie Sizer.

Detective Mary Wheat says Nice has been on family leave but is returning to work.

The motorist who accused Nice of making a rude gesture and pulling a gun on him in Washington County has filed suit against Nice and the city of Portland.

A Washington County sheriff’s deputy wrote a report on the April 3 encounter but no one was cited. Washington County Sgt. Dave Thompson says his deputy did not feel anyone’s conduct rose to the level of a crime.
