UI Foundation faces possible suit over land sale

LEWISTON, Idaho (AP) — The University of Idaho Foundation says it has postponed closing the sale of land on Craig Mountain to the Idaho Department of Fish and Game due to a possible lawsuit by a Washington state man who says he turned in a higher bid.

Foundation Executive Director Nancy McDaniel says the foundation accepted the $122,100 bid from Fish and Game because the agency pledged to allow the university to conduct research and education on the land after it became state property.

But Steve Heitstuman of Clarkston, Wash., contends his bid of $126,000 for the 120-acre parcel known as the Nixon Property should have been accepted in February.

The foundation contends it is a nonprofit and is not a state agency, and its invitation to bid states that it reserved the right to reject any bid at its discretion.
