Jury resumes deliberations in Smart kidnap case

SALT LAKE CITY (AP) — A federal jury has resumed its deliberations in the trial of a street preacher charged with the 2002 kidnapping of Elizabeth Smart.

Brian David Mitchell is on trial in Salt Lake City’s U.S. District Court on charges of kidnapping and unlawful transportation of a minor across state lines for the purposes of illegal sex.

If he is convicted, the 57-year-old Mitchell could spend the rest of his life in prison.

After five weeks of testimony, the case went to the jury of five women and seven men on Thursday. They deliberated about three hours before going home.

The jury has three choices in making its decision: guilty, not guilty or not guilty by reason of insanity.

If they choose the latter, Mitchell would be sent to a federal prison to receive mental health treatment.
