COEUR D’ALENE, Idaho (AP) — Brandon R. Burgess, one of two Washington state men shot outside an Idaho bar, is suing the Coeur d’Alene businessman who faces an attempted murder charge in the shooting.

The 25-year-old is improving at a Seattle hospital after being shot in the abdomen on Dec. 27. He wants payment for medical expenses, lost wages, pain and suffering, according to a lawsuit filed in Idaho’s 1st District Court this week.

Bradley J. Phillips, 25, was shot in the knee and recovering.

Telecommunications business owner Adam Johnson told police he shot the Moses Lake, Wash., men because he felt threatened. Johnson, who also faces an aggravated battery charge, remains in Kootenai County Jail on $500,000 bond.

A preliminary hearing in his criminal case, which is separate from the civil lawsuit, is scheduled for Jan. 8.
