EVERETT, Wash. (AP) — Snohomish County Prosecutor Mark Roe will decide if a deputy was justified in killing a Verlot man who threatened deputies after arguing with a road crew spraying weeds near his home.

The Daily Herald of Everett reports the investigation into the May 29 shooting of Daniel Wasilchen went to the prosecutor Thursday.

Most of the public information about the shooting comes from a search warrant. It says when deputies arrived at the home on the Mountain Loop Highway and ordered Wasilchen to drop his gun, he ordered them to drop their weapons.

The 44-year-old man was hit by three shots fired by Deputy Greg Rasar.

Wasilchen’s family has filed a $5 million claim against the county and the county’s noxious weed abatement coordinator.
