Sheriff appeals concealed handgun permit ruling

MEDFORD, Ore. (AP) — The sheriff of Jackson County has asked the Oregon Supreme Court to overturn lower court decisions that said he was wrong to deny a concealed handgun license to a woman with a medical marijuana card.

Sheriff Mike Winters in 2008 denied Cynthia Willis’ application for a gun permit.

He said granting the permit would violate federal laws prohibiting drug users from legally possessing guns.

Jackson County Circuit Court Judge Mark Schiveley rejected that contention and the Oregon Court of Appeals in June concluded the sheriff would not break the federal Gun Control Act of 1968. The federal act gives states the authority to set rules for gun ownership.

Winters’ petition was filed June 2, a day after Washington County Sheriff Rob Gordon appealed to the Supreme Court in a similar case.
