Wash. high court vacates predator designation

OLYMPIA, Wash. (AP) — The state Supreme Court has reversed a man’s designation as a sexually violent predator.

Curtis Pouncy had a long history of prison time for sexual assaults when a King County jury determined him to be a sexually violent predator — a designation that committed him to the state’s center for sexually violent predators on McNeil Island.

But the high court ruled Thursday that the trial judge in the case omitted a necessary jury instruction about the definition of the term “personality disorder” and allowed improper evidence impeaching the defense expert in the case.

The judges sent it back to King County for a new trial on whether Pouncy meets the definition of a sexually violent predator.
