No charges against Seattle superhero

SEATTLE (AP) — The city of Seattle has decided not to press charges against self-proclaimed superhero Phoenix Jones.

The man whose real name is Ben Fodor was arrested on Oct. 9 on four counts of assault for pepper spraying a group of people outside a downtown Seattle night club. Fodor says he was trying to break up a fight.

City Attorney Pete Holmes says his office had been unable to locate and interview two of the people pepper sprayed. So he believes it would be difficult to convince a jury that Fodor intentionally sprayed everyone at the scene.

Holmes says the case was complicated by Fodor’s explanation that he was coming to the aid of people. State law allows people to use force when coming to the aid of someone that he or she reasonably believes is about to be injured.
