No return to jail for skater Kerrigan’s brother

WOBURN, Mass. (AP) — A Massachusetts judge says former Olympic ice skater Nancy Kerrigan’s brother can’t voluntarily go back to prison.

Mark Kerrigan asked a Superior Court judge in Woburn on Wednesday to send him back to jail to serve the rest of his 2 12-year sentence for assault and battery in connection with the 2010 death of his father.

Kerrigan’s lawyer says the terms of his probation were too much of a financial burden. They include alcohol counseling and anger management classes. Kerrigan is not accused of violating probation.

The judge has denied the request, saying it is not up to Kerrigan to determine whether he will serve jail time or probation.

Kerrigan was joined by family, but his sister was not present.
