Juror: Accuser’s condition key in Cox acquittal

DENVER (AP) — The foreman of the jury that acquitted former Denver Broncos cornerback Perrish Cox of sexual assault charges says jurors agreed Cox had had sex with his accuser, but no evidence was presented on when it happened or in what condition the woman was in.

The woman became pregnant after visiting Cox’s apartment after a night of partying in 2010, and prosecutors said DNA tests indicated Cox was the father. The woman testified she couldn’t remember much of what happened. Cox’s attorney questioned whether the woman simply didn’t remember having sex.

Jury foreman Mitch Summerfield told KUSA-TV in Denver on Tuesday (http://on9news.tv/AdFFZI ) there was no way for jurors to evaluate whether she was awake when she and Cox were together, much less whether Cox knew what condition she was in.
