Defense: Penn State charge should be dismissed

HARRISBURG, Pa. (AP) -- Attorneys for two Penn State administrators charged with lying to a grand jury say the fact that prosecutors have changed the date of an alleged locker room assault on a boy proves that they filed charges before they knew the facts.
The attorney general's office said in a court filing that investigators have concluded that the alleged attack took place in February 2001 rather than March 2002.
Defense attorneys say that means the statute of limitations on a charge against their clients of failure to report has expired and should be dismissed.
Their clients -- athletic director Tim Curley, who is on leave, and retired vice president for business Gary Schultz -- are fighting allegations that they lied to a grand jury and failed to properly report suspected child abuse.
