WALLA WALLA, Wash. (AP) — The lawyer for a Walla Walla store owner who killed an intruder says he fired defending himself and his property.

Attorney Michael Hubbard told KVEW (http://is.gd/i1SF20 ) he expects no charge will be filed against John Saul, owner of the New York Store Western Outfitters.

Saul lives on the property and heard breaking glass early Friday. He confronted an intruder and told him to “hold it.”

The lawyer says the intruder threatened to kill Saul, so he shot him with a shotgun.

The 22-year-old, Cesar Chavira, died at the scene. The Walla Walla sheriff’s office says he was a known gang member with a criminal record.

The sheriff’s office is still investigating the case.
