LARAMIE, Wyo. (AP) — A Wyoming basketball player accused of kicking a man in the face during a bar fight has pleaded guilty to a misdemeanor battery charge.

Deputy Albany County prosecutor Joshua Merseal says Luke Martinez entered the plea Monday in circuit court in Laramie.

A judge sentenced Martinez to 45 days in jail and ordered him to pay $58,000 restitution. He started serving the sentence Monday.

Prosecutors say Martinez kicked an unconscious man outside a Laramie bar in December.

Martinez, of Bismarck, N.D., had faced felony charges of aggravated assault and battery. He was suspended from the team.

His trial had been set for later this month.

But Merseal says the victim was unable to attend the trial. Merseal says that left little chance of convicting Martinez of the original charges.
