EUGENE, Ore. — A state trooper who was ejected from Autzen Stadium, then placed on leave and banned for 18 months from University of Oregon property plans to sue the school and city of Eugene.

Trooper Marc Boyd was never charged but he remains on leave for a state review of the incident.

In a notice of intent to sue, Boyd says he wants to be reimbursed for loss of potential earnings and future advancement.

His lawyer, Sean Riddell, told The Register-Guard it was a case of mistaken identity and he was wrongly identified as a man throwing popcorn at other people in the stands during the Oct. 19 football game between Oregon and Washington State.

The 48-year-old Boyd works as a fish and wildlife officer in the Springfield office.
