SALEM, Ore. — The state filed a countersuit against the family of a Portland boy who fell 60 feet in Silver Park Falls State Park and is suing for up to $875,000.

The Statesman Journal reports 10-year-old Wilson Pelot fell in January after leaning against a broken railing on a trail near Lower South Falls. He fractured his wrist and spine and punctured his lung, among several other injuries.

Pelot’s family sued about a month after the accident, saying the park failed to warn visitors properly of the danger posed by the weak railing.

The state countersued the family April 16, saying the Pelots were negligent by failing to properly supervise their kids while at the park.
