Vancouver man accused in two rape incidents

One victim was allegedly kidnapped

A man suspected in two separate rape cases, one in which he’s accused of kidnapping a woman from a Vancouver nightclub, appeared in Clark County Superior Court on Wednesday.

Tracy Loren Montgomery, 30, of Vancouver entered not-guilty pleas to accusations of first-degree kidnapping with sexual motivation, second-degree attempted rape and second-degree assault with sexual motivation. He also pleaded not guilty to second-degree rape in connection with a Sept. 9 incident.

Montgomery was arrested Tuesday following the end of a police investigation last week.

On Feb. 21, a 29-year-old woman contacted the Vancouver Police Department to report she was physically assaulted and possibly raped earlier that evening. An officer responded to the woman’s residence and learned that she had been at the Q Nightclub & Lounge with friends. The woman said she met a man at the bar, 704 Main St., and agreed to give him a ride home. She said she let him drive her vehicle because he knew where he was going, according to a probable cause affidavit filed in Superior Court.

The man drove to an area on Lower River Road, at which time she asked where he was going. He immediately punched her in the face two times and told her to “shut … up.” He pulled over to the side of the road, grabbed her by the throat and continued to punch her. She said the man began removing her clothes, as she screamed and kicked at him, and attempted to rape her. He continued to punch her and she lost consciousness at times; she said she was unsure if he sexually assaulted her, court records said.

The woman subsequently received treatment for her injuries. She reportedly suffered a concussion and bruising and swelling around her eyes, according to court records.

Police contacted staff at the nightclub who recognized the man and identified him as Montgomery. The woman also identified him in a photo lineup, court records said.

During an unrelated investigation, police found Montgomery was also a suspect in a different incident.

A 35-year-old woman reported she was raped at her residence in September. She said she had known the man, whom she identified as Montgomery, for a couple of months. He reportedly had asked her to have sex numerous times and she continued to say no. He then raped her, according to court documents.

Clark County sheriff’s deputies contacted Montgomery at his home that night and he admitted to knowing the woman, but he denied having any sexual contact with her. About a week later, he contacted a deputy and said he had consensual sex with the woman. He added that he was initially dishonest because his current girlfriend didn’t know he had cheated on her, court documents said.

On Wednesday, Judge Gregory Gonzalez agreed to set Montgomery’s bail at $250,000 and ordered he not have contact with the alleged victims. He also appointed attorney Louis B. Byrd Jr. to represent him. Montgomery’s trial is scheduled to start June 8.
