BONNY LAKE, Wash. (AP) — Construction on the freeway has resumed but criminal charges are unlikely in the Bonney Lake construction accident that killed Josh, Vanessa and Hudson Ellis.

KOMO-TV reports a recently-released Bonney Lake Police Department report quotes the operator of an excavator at the site who says construction workers didn’t have the right equipment to haul away the sections of cement barrier they were cutting.

Bonney Lake city clerk Woody Edvalson says there may have been some negligence, but proving criminal intent is unlikely.

A state Department of Labor and Industries investigation is ongoing. The case is in the hands of the Pierce County prosecutor.

City officials say some of the project’s subcontractors have been removed, and flaggers are being posted on the road below whenever work is being done overhead.
