Mount Vista homeowners association files complaint

Current board members target group over recall election

The Mount Vista Homeowners Association has filed a complaint against the members of Moving Mount Vista Forward over a recall election, which the HOA board of directors deems to be invalid.

The complaint was filed on Sept. 23 in Clark County Superior Court and lists the defendants as Vicki Sparks, Dan Yankovich, Rick Stellfox, Gerold Goodman and James Cave.

Sparks said a vote was held on Sept. 19, and that three of the HOA board members were recalled.

The homeowners association is asking the court to issue a temporary restraining order to prevent any group or individual from attempting to change the members of the board pending a fair election, and also to issue an anti-harassment order.

According to the complaint, the HOA elected a new board of directors in April. The board, among other things, investigated why the community’s pool hadn’t been in use for several years and what to do with it. The pool was ultimately removed because it was too expensive to repair.

After the vote to remove the pool, members of the previous HOA board and their supporters started a campaign to remove the current board members by a vote. Those former members, which make up the group Moving Mount Vista Forward, allegedly collected signatures under the guise that they were trying to save the pool. However, they were actually collecting signatures for a recall of the current board, the complaint alleges.

Members of Moving Mount Vista Forward bullied potential voters, forged documents and opened a separate mailbox under the name of the HOA, according to the complaint.

The HOA is seeking a judgment declaring Moving Mount Vista Forward’s recall election invalid. It additionally seeks a fair election run with verifications by outside observers.

The HOA is being represented by Jordan Ramis PC, which has an office in Vancouver.

Sparks, one of the named defendants, said she and the other defendants retained an attorney early on to guide them through the process. They are being represented by Vancouver attorney Jerry Eline.

She added that she’s not aware of any situations of harassment as described in the complaint.

“As owners, we were quite uncomfortable with the direction our board was taking us, so we were moved to action. And more than ever before, a great number of our members are engaged and excited about the bright future of Mount Vista,” Sparks said.
