Transient man’s prison sentence corrected

A transient man who had part of his prison sentence overturned on appeal was remanded to Clark County Superior Court for resentencing Wednesday. However, it was a moot issue because his 12-year sentence had already been cut nearly in half as the result of a different appeal.

Justin Fessel was serving the sentence between three cases, in part for intentionally ramming a vehicle his brother was driving July 26, 2013, east of Orchards. The crash was reportedly the result of an ongoing family feud.

Fessel was sentenced in 2014 to six years in that case to run consecutive with five years for bail jumping and a year for drug possession, according to court records.

A Washington appeals court last year overturned Fessel’s two bail-jumping convictions, and that sentence was vacated. In February, the higher court found in a separate appeal that Fessel was incorrectly sentenced to serve the vehicular assault and bail-jumping cases consecutively. However, the issue was no longer relevant since the bail-jumping convictions had been overturned.

On Wednesday, the trial court corrected the clerical error, and Fessel was sent back to prison to finish out the rest of his sentence.
