Councilors seek declaratory judgement

Clark County – Clark County filed a complaint Monday asking a Clark County Superior Court judge to declare null and void a referendum petition that puts on hold the Comprehensive Growth Management Plan update.

The Clark County Council voted last week to file the complaint after Christian Berrigan filed a referendum petition with the Clark County Elections Office. The petition, which contained 137 valid signatures, suspended the 20-year growth plan adopted June 28.

Chief Civil Deputy Prosecutor Chris Horne has argued the petition is invalid, citing the county charter, which reads that ordinances required by state or federal law cannot be subject to referendum. Washington requires Clark County to have a growth management plan.

Berrigan has 20 days to respond to the complaint.
