State law prevents Portland from banning no-cause evictions

PORTLAND — Without changes to state law the Portland City Council will be unable to end no-cause evictions in the city.

The Oregonian/OregonLive reports that new analysis by the Oregon Legislative Counsel shows that state law “clearly permits” a landlord to end month-to-month leases without providing reason as long as the landlord provides appropriate notice.

Portland Mayor-elect Ted Wheeler and House Speaker Tina Kotek have each said they want to end the practice of no-cause evictions against renters.

The analysis holds no legal authority and cannot stop the city from enacting local law, but it echoes statements made by the city’s attorney top attorney in April.
