SEATTLE (AP) — A King County Juvenile Court hearing has been set for Sept. 7 to determine if a 10-year-old boy understands an attempted robbery on a Metro bus was a crime.

The boy was in court Tuesday in Seattle with a bandaged arm to have the capacity hearing scheduled. He was wounded in the Aug. 17 incident in which a gun fired during a scuffle with a 17-year-old over a backpack.

The 10-year-old’s two half-brothers — ages 12 and 14 — pleaded not guilty Monday to attempted robbery charges in the case.

The 10-year-old also is charged with stealing a bicycle in June.
