NH Supreme Court weighs in on telephone hearings

CONCORD, N.H. (AP) — An inmate who just wanted his $60 back for magazines he never got from a New Hampshire company may make new law on presenting a case by telephone.

Ronald Buzzard Jr. was incarcerated in Washington state when he filed a small claims complaint in Nashua District Court last year. His request to phone in to present his case was denied and the court dismissed his case when he failed to appear in person.

The New Hampshire Supreme Court has instructed the lower court to reconsider whether Buzzard had a right to present his case by phone — an issue that has never been addressed by the state’s courts.
