SANTA CRUZ, Calif. (AP) — A Seattle man charged with the murder of his girlfriend and their 13-week-old daughter will not fight extradition to Washington state.

Santa Cruz County Assistant District Attorney Andrew Isaac says 30-year-old Daniel Thomas Hicks waived his right to contest being sent back to Seattle during a court appearance Thursday. Isaac says it is up to King County authorities to determine when they want to come to California and take Hicks back to Washington.

Hicks is accused of killing 28-year-old Jennifer Morgan and their infant, Emma. The mother and daughter were found shot to death Dec. 22 in the basement of her parents’ Seattle home, where Morgan had lived for several years with Hicks.

Police used cell phone records to trace Hicks to Santa Cruz.
