Justices reverse ruling in Nampa fatal crash case

BOISE, Idaho (AP) — A Nampa man convicted for killing a motorcyclist in 2003 will get another chance to argue his legal case suffered from poor legal representation.

The Idaho Supreme Court on Friday overturned lower court rulings in the case of Shane McKay. He was convicted of vehicular manslaughter and sentenced to 10 years in prison for driving drunk and crashing into the back of a motorcycle operated by 50-year-old Ted Cox in Nampa on Oct. 5, 2003.

In a post-conviction appeal, McKay argued his trial and subsequent appeal was hampered by when defense lawyers failed to object to a specific instruction given to the jury. Lower courts rejected his appeals, but the Supreme Court justices unanimously disagreed.

The justices vacated the district court ruling and ordered the judge to schedule an evidentiary hearing.
