PORTLAND, Ore. (AP) — A 37-year-old Oregon woman who suffered a serious brain injury when she fell after being shocked by a Sutherlin, Ore., police officer has filed a federal civil rights lawsuit. Erica Price seeks more than $8 million in damages.

She’s suing the city of Sutherlin and Officer Jay Huskey. She accuses the officer of wrongfully zapping her with his Taser X26.

Price acknowledges in the lawsuit filed this week that she was so drunk on the night of Oct. 27, 2009, that she didn’t understand the officer’s commands. Huskey responded when Price’s daughter called 911 to get her mother medical assistance for some cuts.

When she was shocked, Price fell and hit her head.

The Douglas County sheriff’s office reviewed the case last fall. It found that the officer’s actions were “appropriate and justifiable.”
