Ore. developer trial moving to federal court

ALBANY, Ore. (AP) — The trial of a Eugene developer involving cleanup of a former mill site in Oregon is moving from state to federal court.

The Albany Democrat-Herald reports that Linn County prosecutors plan to file a motion to dismiss state air pollution charges against 67-year-old Dan Desler now that a federal grand jury has issued a nine-count indictment against him.

Desler is charged with violating the federal Clean Air Act involving asbestos cleanup. He had planned to build an upscale housing development on acreage along the South Santiam River in the town of Sweet Home — including the former mill site.

Efforts to reach Desler Thursday were unsuccessful. His attorney in the state case says he has not been hired to represent him in the federal case.
