State suing Wahkiakum County over septic sludge

LONGVIEW, Wash. (AP) — Can a county block the use of septic sludge as fertilizer?

The state Ecology Department says no. It sued Wahkiakum County in May, saying a county ordinance is unconstitutional because it conflicts with state regulations.

County commissioners passed an ordinance after residents complained about plans by a Long Beach septic company’s plan to spread biosolids on a Grays River farm.

The Daily News reports (http://bit.ly/qpDcNz) both sides will present oral arguments in the lawsuit Sept. 30 in Cowlitz County Superior Court.
