EVERETT, Wash. (AP) — The family of a man who was shot to death in a dispute over weed control in rural Snohomish County says it will take a civil rights case to a federal appeals court.
The Daily Herald reports (http://is.gd/szyM3g) the lawyer for the family of Daniel Wasilchen says they’ll continue the fight after a federal judge on Wednesday dismissed their lawsuit against the county and a noxious weed inspector.
The family says the weed inspector violated Wasilchen’s right against unreasonable search when he returned to the property at Verlot in 2009 with sheriff’s deputies. Wasilchen was killed when he refused to drop a gun. The prosecutor said the shooting was justified.
The dispute was over spraying for knotweed, an invasive species.
