Letter: Noise complaint full of flaws

Published: April 17, 2013, 5:00pm

We welcome Jesse Hutton of North West Underwater Construction to Washougal. We hope his business is successful. It is regretful there is noise in the industrial park that has irked him.

Due diligence in choosing a business location dictates that one would select a compatible location. Hutton must have been aware of the neighboring uses (kennel) when he decided to move into the Port’s industrial park.

A nuisance ordinance (9.70.040) states in part: “This chapter shall not apply to: … (e) Any animal which is allowed by the zoning code.” The Heavy Industrial zoning allows for kennels (West Columbia Gorge Humane Society). Code Exceptions (11): “Sounds created by lawfully established commercial and industrial uses; and …” thus kennel noise is acceptable.

The Society is a 501(c)3 corporation. There are sites in the industrial park that are available for purchase. A gift of a larger facility for this “no-kill” facility would benefit many and solve his noise complaint.
