Oregon DOJ seeks data from 5-Hour Energy

PORTLAND — The Oregon Department of Justice is demanding unredacted data from the makers and marketers of 5-Hour Energy drink that back its advertising claims.

The Oregonian reports that those claims include that the two-ounce caffeinated energy shot is recommended by doctors and that drinkers don’t experience a crash when the effects wear off.

The state filed legal papers in Multnomah County Circuit Court last week against Innovation Ventures LLC, Living Essentials LLC and Microdose Sales LLC.

A 5-Hour Energy spokeswoman declined comment on Wednesday.

Oregon is part of a group leading a multi-state investigation into the accuracy of the drink’s claims. The states are concerned about the drink’s safety.

A U.S. Food and Drug Administration database contains 92 “adverse incident reports” involving 5-hour Energy, including 11 deaths.

In June, the companies filed a suit trying to block state investigators from getting the unredacted information.
