Clark County bans collective gardens, again

Clark County commissioners Tuesday approved an emergency resolution that will extend a ban on collective gardens for medical marijuana users in unincorporated areas.

The county placed a one-year ban on collective gardens last year.

The emergency resolution calls for a 60-day period, during which the county will hold a public hearing before potentially setting new zoning rules. That hearing has not been scheduled.

When commissioners approved the moratorium in July 2013, there was hope that the state Legislature would readdress how to regulate collective gardens — in light of the passage of I-502, which legalized recreational marijuana — during the 2014 session. That never happened.

The 60-day period is intended to give the commissioners time to make sure regulations they impose meet state law.

“We’ve done it a few times,” Commissioner Tom Mielke said. “We’ll do it again.”
