Battle Ground man accused of pointing loaded rifle at neighbors

A Battle Ground man who allegedly pointed a loaded rifle at his neighbors who were trimming back tree branches made a first appearance Monday in Clark County Superior Court.

Allan C. Cheney, 73, appeared on suspicion of first-degree assault in connection with the Sunday incident in the 22000 block of Northeast 224th Street, court records show.

Clark County sheriff’s deputies were dispatched at about 12:30 p.m. to a report of a firearm being brandished. The victim, Todd Sanders, and a witness, Hayden Sanders, told deputies they were doing yard work and trimming tree limbs that were hanging over the fence line, blocking the access road, when Cheney walked up to them with a rifle, according to an affidavit of probable cause filed in Superior Court.

Cheney loaded the rifle and pointed it inches away from Todd Sanders’ chest and head, and told him he was going to kill him, the affidavit says. Sanders darted behind a tree trunk, but Cheney chased him around the tree with the barrel alternating from the right to left sides. He was yelling, “I’m going to kill you,” the affidavit states.

He eventually unloaded the rifle and said, “If you touch the trees, I will kill you.” Cheney then went back to his house, court documents said.

Court records show that Cheney will hire his own attorney. His bail was set at $15,000, and he will be arraigned Friday.
