Families of 2 women killed by bus to file suit

PORTLAND, Ore. (AP) — Relatives of two women killed by a TriMet bus in a downtown Portland crosswalk have informed the transit agency they plan to file a wrongful death lawsuit.

In a tort claim, victim Jene Hammel’s mother, Vicki Flynn, contends that TriMet and bus driver Sandi Day were negligent. Five pedestrians were hit in the crosswalk late on April 24; three were injured.

Victim Danielle Sale’s father David Sale has also advised TriMet that he’ll file a damage claim. Survivor Robert Gittings has filed his own tort claim against TriMet.

Oregon law requires claimants to send a tort claim to notify public agencies of a pending lawsuit. Day remains off the job on worker’s compensation as TriMet reviews the collision. A Multnomah County grand jury found no criminal wrongdoing by Day, but she was cited for six traffic violations.

TriMet says it doesn’t discuss pending litigation.
