Judge throws out lawsuit against TriMet

PORTLAND, Ore. (AP) — A Multnomah County judge threw out a $1 million lawsuit filed against TriMet by a woman who said the transit agency failed to protect her from being assaulted by a group of teens on a Max train.

Judge Michael McShane ruled Tuesday that Staci Lynn Smith and her lawyer failed to present a case that would persuade a jury that TriMet was negligent.

The Oregonian reports the Vancouver woman was taking her first Max ride in June 2008 when the teens struck her and took her purse. They teens were prosecuted for assault and other crimes.

The TriMet attorney, Jana Toran, said Smith played a role in the altercation by stretching her legs across a vacant seat and refusing to allow a girl to sit down.
