SEATTLE (AP) — A man who had 2 grams of marijuana confiscated at the King County Courthouse is suing the sheriff.

John C. Worthington wants his pot back.

The 47-year-old Renton man told the seattlepi.com he hopes the suit will establish that marijuana is a herbal substance and does not fall under state drug laws. The case is set for Jan. 14 in King County Superior Court.

Worthington says he forgot he had the marijuana in his pocket Oct. 14 when he went to the Courthouse in downtown Seattle to use the law library. The pot was seized at the security checkpoint, but he was not arrested.

A sheriff’s spokesman says the evidence is still being analyzed and the case has not yet been referred to prosecutors.
