VALHALLA, N.Y. (AP) — A law enforcement official familiar with the investigation of the police shooting of a college football player in his car says his blood alcohol level was above the legal limit.

The person tells The Associated Press the level measured for Danroy Henry during his autopsy was 0.13. The legal limit for driving in New York is 0.08.

The person spoke on condition of anonymity because no autopsy report has been officially released.

Twenty-year-old Henry of Easton, Mass., was shot in his car early Sunday after police responded to a disturbance in suburban Thornwood. Police said Henry sped away, hitting two officers after a policeman knocked on his car window.

Henry family lawyer Michael Sussman says police are trying to deflect attention away from what the officers did.
