MINEOLA, N.Y. (AP) — A state Supreme Court judge has denied a request to appoint a special prosecutor to investigate a troubled Long Island crime lab.

Judge William Donnino Thursday afternoon rejected Nassau County District Attorney Kathleen Rice’s bid to remove her office from probing the county crime lab.

The lab was closed last week. Authorities said they’d learned that police supervisors may have been aware since September that errors were occurring in the analysis of drug evidence.

Rice tried to distance herself from the probe because it might involve prosecuting police officers who worked with her office before. Donnino said that alone is not enough to disqualify the DA from investigating.

The lab was placed on probation by a national accrediting agency in December.

Rice did not immediately comment.
