EVERETT, Wash. (AP) — The Monroe prison inmate accused of strangling Correctional Officer Jayme Biendl goes to Everett District Court Thursday afternoon for the first hearing in the case that could result in a death penalty.

The Daily Herald reports the judge will likely set a deadline for Snohomish County Prosecutor Mark Roe to charge Byron Scherf.

The 52-year-old is held for investigation of aggravated murder in the death of the 34-year-old guard on Jan. 29 in the prison chapel.

In a probable cause affidavit released Thursday Scherf is quoted as telling detectives prosecutors should go for the death penalty because he’s already serving a life sentence as a three-strikes convicted rapist.

He told Monroe detectives he strangled Biendl with an amplifier cord because he thought she was disrespectful to others at the chapel.
