LOUISVILLE, Ky. (AP) — The woman convicted of trying to extort a house, cash and cars from University of Louisville basketball coach Rick Pitino wants to remain out of prison while she appeals the case.

Attorney David Nolan filed a motion late Monday asking a judge to allow 50-year-old Karen Cunagin Sypher to remain free until the U.S. 6th Circuit Court of Appeals rules on her case.

A judge on Feb. 18 sentenced Sypher to 87 months in federal prison for trying to extort Pitino to stay quiet about a sexual tryst between the two in 2003. She has remained free since then.

A jury convicted Sypher in August. Nolan says Sypher isn’t a danger to anyone and said the judge made multiple errors in the trial.

Prosecutors have until March 17 to respond to the motion.
