Cop will not be charged in death

SPOKANE, Wash. (AP) — A Spokane County sheriff’s deputy will not be charged for shooting Baptist Pastor Wayne Scott Creach to death last August.

Prosecutor Steve Tucker said Friday said the facts do not support criminal charges against Deputy Brian Hirzel for the shooting last Aug. 25 in the parking lot of Creach’s Spokane Valley nursery business.

Hirzel was in his unmarked squad car when the 74-year-old Creach approached him while armed with a handgun the night of the shooting. Hirzel said he struck Creach with a baton after Creach tucked his gun in his waistband but refused commands to get down. Hirzel said he fired after Creach reached back and took hold of the gun.
