Man’s drunkenness helps him avoid murder charge

PRINEVILLE, Ore. (AP) — A Prineville man was too drunk to know what he was doing when he shot and killed his roommate, a Crook County jury has found.

The Bend Bulletin reports 71-year-old Richard Breneman was convicted Tuesday of manslaughter in the death of his roommate, but avoided a murder charge.

The Nov. 6, 2009 shooting in the Easy Living Trailer Park started with an argument with 54-year-old Voy Powell. Breneman fired a handgun at Powell and struck him in the leg and abdomen.

Breneman had a blood alcohol content of 0.18 at the time of the shooting. An autopsy of Powell showed his blood alcohol content at about 0.23.

Breneman will be sentenced on July 28.
