SALEM, Ore. (AP) — The Oregon Supreme Court has debated the scope of the state’s medical marijuana law concerning a Medford patient who was denied a concealed handgun permit.
The Medford Mail Tribune reports the woman, Cynthia Willis, says the state statute concerning concealed weapons doesn’t explicitly prohibit her from owning a gun.
Jackson County Sheriff Mike Winters denied Willis’ gun permit in 2008, citing a federal law that prohibits drug users from legally possessing guns.
Willis has so far won legal battles against Winters in circuit and appeals courts.
A decision from the state Supreme Court isn’t expected for months.
Willis has allies in the dispute, including Oregon Attorney General John Kroger.
Willis’ attorney Leland Berger says the federal government also gives a state latitude in passing its own laws regarding concealed weapons.
