Yakima prosecutor blew .106 BAC after DUI arrest

YAKIMA, Wash. (AP) — Yakima County Prosecutor Jim Hagarty’s Breathalyzer tests indicated an alcohol level above the legal limit after his drunken driving arrest.

The Washington State Patrol arrest report shows he had breath test results of .106 and .109. The limit in Washington is .08.

Troopers arrested Hagarty after a rear-end collision Tuesday evening in Selah. He released a statement the next day apologizing and saying he would accept the consequences.

The case will be handled by Kittitas County prosecutors.
