OLYMPIA, Wash. (AP) — A man who climbed a fence at an Olympia home is suing the homeowner who shot him as a suspected prowler.

No charges were filed in the April 2010 shooting because the homeowner said he was guarding his property.

The Olympian reports (http://is.gd/UC8S9Q) the wounded man, Michael McMahon, had been staying at a neighbor’s home and was intoxicated when he climbed into Daniel Lipp’s yard about 2 in the morning.

The lawsuit filed last week seeks money for McMahon’s medical expenses and other losses as a result of the shooting.

Lipp declined to comment on the lawsuit.
