Letter: Read bylaws of association

Anybody out there set for joining a Homeowners Association?

RCW 64.38.025 states under Board of Directors — Standard of Care — Restrictions — (2) The board of directors shall not act on behalf of the association to amend the articles of incorporation, to take any action that requires the vote or approval of the owners.

I noticed that my HOA board “adopted” for me a little blue book so nicely printed by their printing press (too bad they aren’t printing money, but I’d probably be liable as a homeowner): Hierarchy of Governing Documents. The hierarchy is good, but I wondered why the information is credited to the collection agency of my HOA, Vial Fotheringham, and not my CC&Rs.

My original Articles were filed with the Secretary of State and the bylaws were rightfully adopted by homeowners. My bylaws were amended in 1986. All homeowners are protected and may rely on the articles and bylaws. Read yours.

Buyers, beware. Owners: vote any board member who did this out of his seat during April elections.
