Mariah Carey is being sued once again for copyright infringement over her Christmas anthem “All I Want For Christmas is You.”
The massively successful holiday song — which was initially released as the first single of Carey’s fourth studio album, “Merry Christmas,” in 1994 — went on to become one of the most popular Christmas songs in recent memory, reaching the top of the U.S. charts for the past four years in a row.
But according to Andy Stone, a country singer who released a song with the same name in 1989, “Carey has capitalized on the success of her infringing work,” the lawsuit reads in part, according to The Wrap.
Stone, who performs as Vince Vance & the Valliants, as well as Troy Powers, who’s credited as co-author of the 1998 version of the song, are reportedly seeking $40 million in damages.
The country musician had already sued the elusive chanteuse in June 2022 alleging Carey had exploited his “popularity” and “style.”
About five months later, Stone told the court he would dismiss the case.
In the new lawsuit, the two songwriters point at similarities between the two songs, adding Carey “palmed off these works with her incredulous origin story, as if those works were her own,” TMZ reported.
News of the refiled lawsuit broke just hours after the five-octave diva took to social media to officially welcome the holiday season.
In a video shared on social media at the stroke of midnight on Wednesday, Carey is seen breaking out of a block of ice, singing her signature high note, and dancing to “All I Want for Christmas.”
“It’s … TIME!!!” the multi-Grammy-winning singer wrote.
Carey’s 13-city “Merry Christmas One and All!” concert tour gets underway on Nov. 15 in Highland, Calif., before wrapping up in New York City on Dec. 17.
