Trial starts for airman accused of hiding his HIV

WICHITA, Kan. (AP) — A lawyer for an Air Force officer accused of having unprotected sex with multiple partners without telling them that he’s HIV positive says that the latest scientific research shows such action does not amount to aggravated assault.

The opening statement Tuesday by one of Tech. Sgt. David Gutierrez’s military lawyers offered a first glimpse at the strategy the defense will employ.

Gutierrez is charged with 10 counts of aggravated assault and with violating his squadron commander’s order to notify his sexual partners about his HIV status and to use condoms.

Gutierrez’s attorneys entered not guilty pleas to all charges at the start of the court martial proceedings in Wichita, Kan. A military judge rejected defense arguments that the assault charges were unconstitutional.
